No. Talkspace follows North Carolina state guidelines for minor consent (NCGS 90-21.5(a)). If you’re at least 13 years old, you can consent to your own mental health treatment, you don’t need a parent or guardian to sign off.
During sign-up, you’ll go through a quick consent process directly on the platform before being matched with a therapist.
Is everything you share with my therapist confidential? How is my privacy considered?
Yes, everything you share with your therapist is confidential, except in certain situations where therapists are legally required to share information. These include:
- If there is a serious risk of harm to yourself or someone else
- If there is suspected abuse or neglect of a minor or vulnerable adult
- If Talkspace receives a court order, subpoena, or request from a state agency (like DSS) that requires us to share specific information
Your therapist will talk with you about these limits to confidentiality early on so you know what to expect.
Outside of those rare exceptions, your sessions stay private. Talkspace is HIPAA-compliant, uses strong encryption to protect your information, and will never share your personal data without a valid legal or safety reason. We also collect emergency contact information as part of our safety protocols, but it’s only used if a serious safety concern arises.
When can you use Talkspace?
You can use Talkspace before or after school, during weekends, and whenever is most convenient for you. You can send messages to your Talkspace provider 24/7. Depending on their schedule, providers generally respond every day, 5 days per week. We do recommend that you follow your school's policy around phone usage during school hours.

Parental/guardian consent is not required for minors eligible to self-consent under state law. However, if a parent is involved in initiating care, they may be asked to review or acknowledge consent materials based on the referral path.
